What Would Jack Bauer Do?

This is not a joke, a Judge has defended Jack Bauer for his actions and says that because of what he has shown is accomplishable on TV it should be done in real life. Apparently Jack Bauer saved many lives by torturing people, who'd hold him to court?

"Are you going to convict Jack Bauer?" Judge Scalia challenged his fellow judges. "Say that criminal law is against him? 'You have the right to a jury trial?' Is any jury going to convict Jack Bauer? I don't think so.
