Non-US Citizens Not People, Rules US Judge

How can you charge someone with a crime they comitted yet refuse to accept any defense they use under the same banner of laws in which they were charged? We are on a slippery slope and things are going from bad to worse as now a US judge has ruled that even if torture and religous abuse were illegal (they actually are) they would supposedly not apply to non-US citizens provided the acts were comitted off US shores.
Yet the way the constitution reads is 'people', not 'Americans' and it's 'we hold these truths to be self evident, that all men are created equal'. The way the justice system is set up in virtually ever developed nation works under the principle you can defend yourself using the same law books that were used to take you to court. It's simple common sense, I can't simply accuse you of murder under US law then when you demand we go to court over my accusations I highlight the fact you aren't a US citizen therefore you are untriable under US laws. I'm convicting you under US laws for crying out loud!
To accept torture is acceptable on any level and justify it by saying those being tortured are not recognized by the constitution as people, literally, people, is a grave sin. Guantanamo was set up for the soul purpouse of creating fear amongst the American populace, virtually none of the suspects have been trialed, many could have simply been taken off the street and thrown in there. There is little to no evidence any of them are enemy combatants, the Bush Administration has for all these years refused to try them in a court of law, now this ruling simply adds credibility to animals and mind you those animals are not the detained.
The world does not see those imprisoned in Guantanamo as non-human. No one is chearing on the US in its crusade against terror, increasingly people see the US as the number one threat to world peace, not terrorists or rogue states, just the United States of America. When it comes down to it all people see, and they know, if we are going to go down the path the enemy takes why do we fight them?
We have broughout ourselves down to the bottom of moral reprehensibility that some of us are now justifying these court rulings and crimes as justifiable because our enemy would do the same. If we are going to become even a little bit like them why do we insist on taking them down? In the process of fighting monsters the Bush Administration has become a monster far more dangerous than any we have seen in modern history. Al-Qaeda cannot take me from the streets and torture me without charge but the Bush Administration can.
